Ledesma Grabados de Arte, S.L. with VAT ID B-80999444 (registered in the Madrid Commercial Register, Volume 8,644, Folio 1, Section 8, Sheet M-139456, Entry 1) sells original works of art via the website www.a-cuadros.com, hereinafter A CUADROS. Sales transactions shall be deemed to have been carried out in Calle Augusto Figueroa, 41, ground floor, right door, Madrid (Spain).
Ledesma Grabados de Arte, S.L. describes the works rigorously, always taking into account the information provided by the artists and editors, including information on the technique, editing, size and title of each of the pieces, in order to provide the customer with as much information as possible.
The user understands and agrees that A CUADROS makes all reasonable efforts to display the colours of original works of art with the greatest accuracy via the Website. However, since the colour may vary according to the device, monitors, or operating system used by the user, the colour of the work displayed may show slight variations with respect to the original colour. The entire work is guaranteed; hence it is sold as genuine and correctly described.
The customer interested in a work may purchase it and request from Ledesma Grabados de Arte, S.L. any additional information concerning its technical and artistic characteristics, the delivery time, etc.
The selling price shown on the website does not include taxes, which will be passed on to the customer according to his / her tax circumstances. A CUADROS reserves the right to change its prices at any time but undertakes that the works sold will be invoiced at the price in force at the time of registration of the order. This price does not include the shipping costs that will be detailed during the purchase process and included in the total amount of the transaction.
On the basis of the purchase request, Ledesma Grabados de Arte, S.L. will send the customer a confirmation email containing the total amount of the purchase, including taxes and shipping costs.
Together with the work, a purchase invoice and certificate of authenticity of the work will be sent.
The purchase shall not be deemed to have taken place until payment is made for Ledesma Grabados de Arte, S.L. If, for any reason, after the reservation no confirmation of the payment has been received, A CUADROS shall notify the purchaser of the cancellation of that reservation.
The customer may make the payment by credit or debit card through Visa, Mastercard, Visa electron and/or other similar cards, or through the PayPal payment system. The customer must notify A CUADROS, as promptly as possible via the Contact section, of any undue or fraudulent charges on the card used for purchases on the Website, in order to enable A CUADROS to take the necessary steps.
A CUADROS has the highest safety measures available commercially in the sector. The payment process also works on a secure server using the SSL (Secure Socket Layer) protocol. A CUADROS also represents that it does not have access to or store sensitive data relating to the means of payment used by the customer. Only the corresponding payment processing entity has access to this data by way of payment and collection management.
The purchaser may cancel an order in whole or in part by communicating to A CUADROS before the work/s is/are in the possession of the transport company responsible for its delivery. If the package has already left the premises of A CUADROS, the purchaser will have to return it as indicated below.
The purchaser shall receive the work at the address provided by him/her for deliveries in mainland Spain within approximately two (2) to four (4) working days from the date of completion of the purchase unless the customer has been notified of a different period for stock reasons or for the specific needs of the work. Shipments outside mainland Spain and abroad will have different dispatch times, which will in any case be brought to the attention of the customer. In order to optimise the delivery process, the address indicated by the customer should be an address to which delivery can be made within normal working hours.
The works are insured, so it is very important that any visible damage to the packaging is notified to the staff of the transport company in order to be able to deal with any complaints if any damage has occurred during the shipment.
If, at the time of delivery of the product at the address indicated, the customer is absent, the carrier shall give notice of how to proceed with a new delivery. If, after ten (10) calendar days from the date of the notice, the customer has not contacted the carrier to agree on a new delivery date, the works shall be returned to the warehouses of A CUADROS and the customer shall bear the costs of dispatch and return, as well as any associated management costs.
Upon receipt of the work, the purchaser may, within fourteen (14) calendar days, exercise his/her right of withdrawal and return it. The cost of the return to the offices of Ledesma Grabados de Arte, S.L., Calle Augusto Figueroa, 41, ground floor, right door, 28004 Madrid (Spain), will be paid back on his/her own account and risk.
The customer shall not have the right to withdraw in the cases provided for in the applicable legislation and, in particular, including but not limited to, in the case of works drawn up in accordance with the customer’s specifications or clearly customised.
The work must be in the same state as that in which it was delivered and must keep instructions, documentation, accessories and, as far as possible, its original packaging and labelling. The return to A CUADROS must be made using the same box or envelope used in the delivery or, failing that, in a similar format guaranteeing the return of the works in perfect condition. In this regard, A CUADROS reserves the right to accept it or not if it is not in the state in which it was delivered.
Once the customer has notified its intention to return and confirms that the works to be returned are packaged, A CUADROS will schedule the collection of the works and inform the customer by email of the date and time of the collection.
In the event of exercising the right of withdrawal, the customer shall be entitled to reimbursement of the price of the returned works, in addition to the delivery costs, but not the return costs, which will be paid for by the customer. Partial returns of an order shall give rise to reimbursement of the price and partial delivery costs calculated pro rata on the basis of the value of the works returned.
A CUADROS shall check the adequacy of the returned work, and reserves the right not to make the refund if it is found that the purchased and returned work do not match or that the refund has not been made in accordance with these Terms and Conditions.
A CUADROS shall manage the order for the refund of the price and delivery charges using the same payment system as used by the customer for the purchase of the works, within forty-eight (48) hours of confirmation of the arrival of the returned order at its premises, and in any event not later than fourteen (14) calendar days after the customer gave notice of the withdrawal. The application of the refund of the price and delivery charges to the account or card of the customer depends on the card and the issuing entity. The period of application of the price refund shall be up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards.
The customer shall be entitled to reimbursement of the price, shipping costs and transport costs of the return from the address at which the defective works or works delivered not corresponding to the order made by the customer, in accordance with the applicable legislation and these Terms and Conditions.
In the event that any clause in these Terms and Conditions is declared null and void, the other Clauses shall remain in force and shall be interpreted in the light of the will of the parties and the purpose of those Terms and Conditions. Failure by A CUADROS to exercise any right arising from these Terms and Conditions shall not be construed as waiving that right unless it expressly renounces that right in writing or that the action in each case is time-barred.
In relation to any dispute concerning the interpretation or enforcement that may arise, the parties submit to the courts and tribunals of metropolitan Madrid (Spain), expressly waiving any other jurisdiction which they may have.
A CUADROS shall send to the customer an email confirming the purchase made. Orders for works, and therefore the agreement, shall be deemed to have been entered into and concluded when payment of the price is received by A CUADROS.
Payment of the price and the shipment costs of the works purchased via the Website is made when A CUADROS sends to the customer an email acknowledging receipt and confirmation of the purchase made.
The proof of purchase corresponding to the works order will be available and can be displayed in the My Account section: Order history. The customer will also be able to download the invoice for the order in this section.
